These Terms of Service govern your use of the AzNConnect mobile app and website operated by AZNConnecT (ABN 66 606 519 696). Please read them carefully.
Acceptance of these Terms
These Terms of Service (“Terms”) form a binding agreement between you and AZNConnecT (ABN 66 606 519 696) (“we”, “us”). By creating an account, accessing or using the AzNConnect mobile application or website (the “Service”), you agree to be bound by these Terms and our Privacy Policy.
If you do not agree, do not use the Service.
Eligibility
You must be at least 18 years old and able to form a binding contract under the law of your jurisdiction to use the Service. By creating an account you represent that you meet these requirements and that the information you provide is accurate and current.
Your account
When you create an account you agree to:
- Provide accurate and complete information.
- Keep your password secret and not share your account with anyone else.
- Notify us immediately if you suspect unauthorised access.
- Be responsible for all activity that occurs under your account.
Acceptable use
When using the Service you must not:
- Post or transmit unlawful, harassing, defamatory, hateful, obscene, infringing or otherwise objectionable content.
- Impersonate another person or misrepresent your affiliation.
- Upload viruses, malware, or any code that could damage or interfere with the Service.
- Attempt to gain unauthorised access to any account, server or network connected to the Service.
- Scrape, copy or redistribute content from the Service without our permission.
- Use the Service to send spam or unsolicited communications to other users.
- Use the Service for any unlawful purpose or in breach of any applicable law.
User content
You retain ownership of the content you upload (such as your profile photo and bio). By uploading content you grant us a non-exclusive, royalty-free, worldwide licence to host, display and distribute that content within the Service for the purpose of operating it.
You are responsible for the content you post and you represent that you have the right to share it. We may remove user content that we reasonably believe breaches these Terms or any applicable law.
Events, tickets and reservations
AzNConnect lists events, including paid events, run by us or our community partners. When you reserve a ticket:
- A reservation is confirmed only after payment is successfully processed by Stripe.
- You will receive a unique ticket code in the app under “My Tickets” which must be presented at the event.
- Tickets are non-transferable unless we expressly agree otherwise.
- Refunds for paid events are not generally available, except as required by Australian Consumer Law or as described on the event listing.
- We may change, cancel or reschedule events. If we cancel a paid event we will refund the ticket price.
Premier Membership
Premier Membership is an optional, one-off annual purchase that entitles you to discounted ticket prices on AzNConnect-run, in-person events held in the city you select at purchase. Membership does not unlock any digital content or features within the app or website — its sole benefit is reduced pricing on real-world event tickets.
Membership is processed through Stripe Checkout. Pricing, the city of validity, and the membership term are shown at the point of purchase. The membership is valid for 12 months from the purchase date and does not auto-renew. If we ever introduce auto-renewing membership, that change will be communicated to you and will require your renewed consent.
Memberships are non-refundable except where required by Australian Consumer Law. To request a refund, contact admin@aznconnect.com.au.
Push notifications
If you enable push notifications, we may send you region-targeted and industry-targeted notifications about events that match your profile, as well as transactional messages such as ticket confirmations. You can disable notifications at any time in your device settings.
Termination and account deletion
You can permanently delete your account at any time from Profile → Delete Account in the app. Deletion is irreversible and will remove your profile, RSVPs and saved data.
We may suspend or terminate your account, with or without notice, if you breach these Terms or if we reasonably believe your conduct may cause harm or legal liability to us or other users.
Intellectual property
The Service, including the AzNConnect name, logo, branding, design and software, is owned by AZNConnecT and is protected by copyright and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service in accordance with these Terms, for personal and non-commercial use.
Third-party services
The Service integrates with third-party providers (including Stripe, Apple Push Notification Service, Google Firebase Cloud Messaging and Cloudflare). Their services are governed by their own terms and privacy policies. We are not responsible for the content or practices of any third-party services or websites that we link to.
Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind. We do not warrant that the Service will always be available, error-free, secure or that defects will be corrected.
Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot be excluded under the Australian Consumer Law. Where our liability cannot be excluded but can be limited, our liability is limited (at our option) to re-supplying the Service or paying the cost of having the Service re-supplied.
Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or business opportunity, arising out of or in connection with your use of the Service. Our aggregate liability arising out of or in connection with the Service is limited to the greater of (a) AU$100 or (b) the total amount paid by you to us in the 12 months preceding the event giving rise to the claim.
Indemnity
You agree to indemnify us and our officers, employees and contractors against any loss, liability, claim or expense (including reasonable legal fees) arising out of (a) your breach of these Terms, (b) your misuse of the Service, or (c) your violation of any law or any rights of a third party.
Changes to these Terms
We may update these Terms from time to time. The “Effective” date at the top of this document indicates when they were last revised. If the changes are material we will notify you in-app or by email before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
Governing law and jurisdiction
These Terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts of appeal from them.
Apple-specific terms
If you obtained the AzNConnect app from the Apple App Store, you acknowledge that:
- These Terms are between you and us, not Apple. Apple is not responsible for the app or its content.
- Apple has no obligation to provide maintenance or support for the app.
- In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, who will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
- We, not Apple, are responsible for addressing any claims by you or any third party relating to the app or your use of it.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
